On July 24, the Commercial Court of Kyiv opened proceedings in the case No. 910/8992/19 on the bankruptcy of PJSC Odeskyi korovai and imposed a moratorium on meeting creditors` demands.
The reason for that was the appeal of PJSC Odeskyi korovai itself, taking into account the relevant decision of the General Meeting of Shareholders of the company, adopted in March 2019.
In addition, at this meeting of PJSC Odeskyi korovai shareholders the issue of approval of the plan of reorganization before the opening of bankruptcy proceedings and the introduction of a moratorium on creditors` claims should have been considered, among other things.
The court records mention that the company owes over USD 23 million to Sberbank.
PJSC Odeskyi korovai is associated with Oleksandr Lieshchinskyi`s Lauffer Group - one of the largest agro-reprocessing facilities in Ukraine (specializes in the manufacture of flour, bakery products, fat and oil products, canned food and other products).
On 19.02.2019 the Supreme Court upheld the decision of the lower courts (Case No. 908/130/15-г), by which another company from this group - Trade House Zolotyy Urozhay LLC - was declared bankrupt and a liquidation procedure was opened.
Back in 2015, as part of this case, the Commercial Court of Zaporizhzhia Region recognized the claims of a number of banks, including Oshchadbank (UAH 1.65 billion), Sberbank (UAH 793 million), Credit Dnipro (UAH 487 million), Zlatobank (UAH 64 million), and Delta Bank (UAH 30 million).
In court materials it was stated that "objects of real estate and land plots of Trade House Zolotyy Urozhay LLC, as well as a significant part of corporate rights were withdrawn from the property of the company during the last year before the initiation of bankruptcy proceedings.
On January 16, 2019, the Supreme Court refused to satisfy the cassation appeal of Oleksandr Lieshchinskyi and upheld the decision of the Donetsk Regional Court of Appeal dd. 13.07.2017 (in case No. 242/3874/15-ц), which satisfied the claim of Sberbank and recovered from Oleksandr Lieshchinskyi as a guarantor of Trade House Zolotyy Urozhay LLC USD 23.1 million of the debt under the loan agreement No. 26-H / 12/24 / ЮО-KL dd. 06.03.2012.
At the same time, on 22 May 2019, the Commercial Court of Donetsk Region refused to open proceedings in the case No. 905/2382/18 on the bankruptcy of Mariupolskyi mlynkombinat LLC (according to the data of the state register, the final beneficiary is Oleksandr Lieshchinskyi), which was initiated by Sberbank.
The courts also are considering the case No. 902 / 672/16 on the bankruptcy of Trade House Zolotyy Urozhay LLC (according to the State Register, the ultimate beneficiary - O. Lieshchinskyi). The relevant proceedings were opened in August 2016 at the request of Ukrgasbank (the amount of recognized claims is UAH 14.9 mln).
In the course of the litigation, their creditor claims against Trade House Zolotyy Urozhay LLC declared Oshchadbank (UAH 2.16 billion), FUIB (UAH 881 million), Sberbank (UAH 656 million), Credit Dnipro (UAH 493 million) and Delta Bank (UAH 304 million). At the same time Oschadbank unsuccessfully tried to close the production on this case.
