On May 7, the Commercial Court of Mykolaiv Region partially satisfied Prominvestbank`s claim against the State Enterprise Mykolayiv Armoured Plant (in case No. 915/1000/18) and decided to recover UAH 7,9 mln from the defendant in favor of the plaintiff (on the basis of the agreement on opening a credit line No. 202-04/07 dated 23.03.2007).
According to court materials, in April 2011 the same court in another case (№ 5016/193/2011 (1/24)) granted the claim of the Russian state bank`s "daughter" on recovery of UAH 3.36 million of debt from the state enterprise under the same loan agreement, but the relevant court decision was not executed.
On June 5, the Commercial Court of Mykolaiv Region issued an order for the implementation of the decision of May 7, 2019.
On July 8, the Pivdenno-Zakhidnyi Commercial Court of Appeal has returned the appeal against the decision of the court of first instance dated May 7 (due to the appellant`s failure to provide proper evidence of payment of the court fee) to Mykolaiv Armored Plant.
At the same time, the State Enterprise noted that it could not pay the court fee due to the fact that it fulfills the state defense order for 2019 within the framework of the program related to the improvement of the defense capability and security of the state, approved by the Cabinet of Ministers and financed by the loan funds under state guarantees.
Also, Mykolaiv Armored Plant informed that at the moment it owes about UAH 34 million and carries out various court decisions by installments, paying the funds under the cases № 915/270/15; 915/861/14; 915/330/15; 915/1854/18.
