Privatbank lost mortgage rights to hundreds of hectares of land in the Odesa region at the Supreme Court

On June 18, the Supreme Court refused to satisfy the cassation appeal of Privatbank and left unchanged the decision of the lower courts in the case № 910/15832/17, which partially satisfied the claims of LLC Hadzhybei (not alien to the former bank`s owners) to Privatbank and invalidated two secondary mortgage agreements (No. 4886 and No. 4952) concluded by the parties to the litigation in June-July 2016 as security for LLC Tamersa`s obligations to Privatbank. The court made such a decision taking into account that, according to its conclusion, the agreement on the part of the mortgagor was signed by an unauthorized person.

According to the court materials, LLC Hadzhybei also asked the court to invalidate the primary mortgage agreements (the subject of the mortgage is the same - 41 land plots with an area of more than 300 hectares), which were concluded with the NBU as security for the debt obligations of PrivatBank on refinancing. However, these claims were rejected.

According to Finbalance, the resolution of the Pechersk District Court of Kyiv City dd. 05.02.2019 satisfied the request of the Office of the Prosecutor General of Ukraine within the framework of the criminal proceedings No. 4201400000000001261 (on UAH 19 billion of refinancing attracted by Privatbank in the NBU prior to the nationalization) and imposed an arrest on the property of the "Privat" structures (with a ban on disposition and alienation of the respective assets), including LLC Hadzhybei (34 land plots at the address: Odesa region, Ovidiopol district, Dilnitsk village council, Zolotyi bereh massif).

According to the State Register, the founders of LLC Hadzhybei are Oleksandr Sachkov, Dmytro Potishman, LLC Dilvest (among the founders of which are Viacheslav Derishev, Yevhen Petrov, Volodymyr Kravchenko, Dmytro Davydenko, the Cypriot company Valenza Consulting Limited).
